  1. NCOMPASS END USER LICENSE AGREEMENT

  3. Within this license agreement :
  4.  
  5. YOU MAY: use the Software on any computer; or copy the Software 
  6. for archival purposes, provided any copy must contain all of the 
  7. original Software's proprietary notices.
  8.  
  9. YOU MAY NOT: permit other individuals to use the Software
  10. except under the terms listed above; modify, translate,
  11. reverse engineer, decompile, disassemble (except to the
  12. extent applicable laws specifically prohibit such
  13. restriction), or create derivative works based on the
  14. Software; copy the Software (except for back-up purposes);
  15. rent, lease, sell or otherwise transfer rights to the
  16. Software; or remove any proprietary  notices or labels on the
  17. Software.

  19. TITLE. Title, ownership rights, and intellectual property
  20. rights in and to the Software shall remain in ExCITE. The Software 
  21. is protected by the copyright laws of Canada and international copyright
  22. treaties.  Title, ownership rights, and intellectual property
  23. rights in and to the content accessed through the Software is
  24. the property of the applicable content owner and may be
  25. protected by applicable copyright or other law. This License
  26. gives you no rights to such content.

  28. DISCLAIMER OF WARRANTY. This Software is provided free
  29. of charge, and is in its alpha release. So it is provided 
  30. on an "AS IS" basis, without warranty of any kind, including, 
  31. without limitation, the warranties of merchantability, fitness 
  32. for a particular purpose and non-infringement. The entire risk 
  33. as to the quality and performance of the Software is borne by you.
  34. Should the Software prove defective, you and not ExCITE
  35. assume the entire cost of any service and repair. In this version 
  36. of the software no security mechanism is included.
  37.  
  38. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO
  39. LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL EXCITE
  40. BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, 
  41. INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, 
  42. WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE,
  43. COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  44. COMMERCIAL DAMAGES OR LOSSES.  THIS LIMITATION OF LIABILITY SHALL NOT
  45. APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT
  46. APPLICABLE LAW PROHIBITS SUCH LIMITATION.

  48. MISCELLANEOUS. This Agreement represents the complete
  49. agreement concerning this license between the parties and
  50. supersedes all prior agreements and representations between
  51. them. It may be amended only by a writing executed by both
  52. parties. If any provision of this Agreement is held to be
  53. unenforceable for any reason, such provision shall be
  54. reformed only to the extent necessary to make it
  55. enforceable. This agreement shall be governed by and construed
  56. pursuant to the laws of British Columbia.

  58. TERMINATION.  This license will terminate automatically if
  59. you fail to comply with the limitations described above.  On
  60. termination, you must destroy all copies of the Software.
